Article 1. Applicability
1.01. All offers, orders and agreements of Bij SMAAK Handelsonderneming (hereinafter: BijSMAAK.com) shall be subject to these General Terms and Conditions (hereinafter: Terms and Conditions) to the exclusion of any other general terms and conditions. These Terms and Conditions can be accessed via the Internet at: www.bijsmaak.com.
1.02. Accepting an offer or placing an order, regardless of which means of communication you use, constitutes your acceptance of these Terms and Conditions.
1.03. Deviation from these Terms may only be made in writing, with other provisions remaining in force.
1.04. All rights and claims stipulated in these Conditions and in any other agreements for BijSMAAK.com shall likewise be stipulated for intermediaries and other third parties engaged by BijSMAAK.com.
1.05. BijSMAAK.com shall be entitled to amend its terms and conditions of delivery and/or payment.
1.06. You must immediately report to BijSMAAK.com any inaccuracies in the data provided to you by BijSMAAK.com, as well as any changes or inaccuracies in your data provided to BijSMAAK.com.

Article 2. Offers/Agreements
2.01. All our offers on BijSMAAK.com are without obligation and we expressly reserve the right to change prices, in particular when required by (statutory) regulations.
2.02. An agreement is only concluded after we accept your order. This occurs when we confirm your order by e-mail. BijSMAAK.com is entitled to refuse orders or to attach special conditions to delivery, unless expressly stated otherwise. If an order is not accepted, we will communicate this within ten (10) working days of receiving the order.

Article 3. Prices and payments
3.01. The prices stated for products and services are in euros, including VAT and excluding handling and shipping costs, unless otherwise stated or agreed upon in writing.
3.02. If you default on any payment, BijSMAAK.com shall be entitled to suspend or cancel (the performance of) the relevant agreement and related agreements.
3.03. If the prices for the products and services offered increase in the period between the order and its execution, you shall be entitled to cancel the order or rescind the agreement within ten (10) days after notification of the price increase by BijSMAAK.com.
3.04. BijSMAAK.com guarantees that prices will not be increased within the term of actions, unless legal measures make this necessary. Price reductions may, however, occur.
3.05. Unless otherwise stated, shipping costs will be charged on every order. The amount of these charges will be stated with your order and in the FAQ pages.
3.06. When paying by VISA/Mastercard, BijSMAAK.com has the right to check that the card is valid, that there is sufficient spending limit to debit the total amount and that your address details are correct. BijSMAAK.com reserves the right to refuse the purchase.
3.07. For cash payment, you can use iDeal. You can then settle the payment directly during the ordering process through your own bank.

Article 4. Delivery
4.01. Delivery by BijSMAAK.com shall be made expeditiously but at least within thirty (30) days of ordering, unless otherwise stated by BijSMAAK.com. If delivery is not made on time, you will be notified within 1 week of placing the order and until the time of delivery you will be entitled to dissolve the agreement free of charge by notifying BijSMAAK.com in writing. Exceeding the delivery period shall not entitle you to compensation.
4.02. Delivery shall take place the moment the product is received by (or on behalf of) you.
4.03. BijSMAAK.com exercises the utmost care in accepting and dispatching orders.
4.04. BijSMAAK.com will ship approved orders as soon as possible and in order of receipt. Normally, orders will be delivered approximately 2 business days after the order date.
4.05. Damaged items, if not used, will be replaced by BijSMAAK.com free of charge.

Article 5. Retention of title
5.01. Ownership of products delivered shall not be transferred until you have paid everything owed to BijSMAAK.com under any agreement. The risk in respect of the products shall pass to you at the moment of delivery.

Article 6. Complaints and Liability
6.01. You are obliged to inspect the products delivered immediately upon receipt. Any defects found must be reported to BijSMAAK.com in writing, stating reasons, within two (2) weeks of discovery.
6.02. If it is established that the products do not meet the requirements of the agreement, BijSMAAK.com shall have the option of replacing the products in question with new products upon their return or refunding the invoice price thereof.
6.03. If you do not wish to accept a product for whatever reason, you shall be entitled to return the product to BijSMAAK.com within thirty (30) days of delivery and to cancel the agreement. Returns will then only be accepted if the product packaging is undamaged. The corresponding payment already received by BijSMAAK.com shall be refunded no later than thirty (30) days after return receipt.
6.04. In the event of a return, the items to be returned must be returned to BijSMAAK Trading Company unused, undamaged and complete in their original packaging. Shipping costs will be borne by the customer. Shipping costs remain the same regardless of the number of items you have purchased. If you return your order, we will charge return shipping costs.
6.05. We reserve the right to charge any costs in case of damage caused by you to returned items.
6.06. After the expiration of the trial period, the purchase agreement becomes a fact.
6.07. BijSMAAK.com shall not be liable to you for any loss or damage except in the event that its liability insurance covers the loss or damage and insofar as the insurer makes payment where appropriate. Liability shall always be limited to a maximum of the purchase price of the item(s) in question.
6.08. BijSMAAK.com shall never be liable for consequential damage.

Artikel 7. Bestellingen/communicatie
7.01. Voor misverstaan, verminkingen, vertragingen of niet behoorlijk overkomen van bestellingen en mededelingen ten gevolge van het gebruik van internet of enig ander communicatiemiddel in het verkeer tussen u en BijSMAAK.com, dan wel tussen BijSMAAK.com en derden, voor zover betrekking hebbend op de relatie tussen u en BijSMAAK.com, is BijSMAAK.com niet aansprakelijk, tenzij en voor zover sprake mocht zijn van opzet of grove schuld van BijSMAAK.com.
7.02. Alle goederen zijn doorgaans uit voorraad leverbaar. Het kan echter voorkomen dat een artikel tijdelijk niet op voorraad is. In dat geval krijgt u daarvan, in de regel binnen een week bericht en houdt BijSMAAK.com uw bestelling aan. Indien nalevering uiteindelijk niet meer mogelijk is, krijgt u ook bericht en komt uw bestelling te vervallen. Alle gemelde of vermelde leveringstermijnen zijn slechts een indicatie en leiden niet tot enig recht of aansprakelijkheid.

Article 8. Force Majeure
8.01. Without prejudice to the other rights to which it is entitled, BijSMAAK.com shall, in the event of force majeure, be entitled, at its option, to suspend fulfillment of your order or rescind the agreement without judicial intervention, by informing you of this in writing and without BijSMAAK.com being obliged to pay any compensation, unless in the given circumstances this would be unacceptable according to the standards of reasonableness and fairness.
8.02. Force majeure shall mean any failure to perform which cannot be attributed to BijSMAAK.com because it cannot be attributed to BijSMAAK.com and is not for its account by virtue of the law, legal act or generally accepted practice. For example in case of strikes, illness among staff, transport failures and import/export bans, regardless of whether this occurs at the company or at its suppliers.

Article 9. Miscellaneous
9.01. If you provide BijSMAAK.com with an address in writing, BijSMAAK.com shall be entitled to send all orders to that address unless you notify BijSMAAK.com in writing of another address to which your orders should be sent.
9.02. If BijSMAAK.com allows deviations from these Terms and Conditions, whether tacit or not, for a short or long period of time, this shall not affect its right to demand immediate and strict compliance with these Terms and Conditions. You may never invoke any right on the grounds that BijSMAAK.com applies these Terms and Conditions flexibly.
9.03. If one or more of the provisions of these Terms and Conditions or any other agreement with BijSMAAK.com should be in conflict with any applicable legal requirement, the provision in question shall cease to have effect and shall be replaced by a new comparable provision to be determined by BijSMAAK.com.
9.04. BijSMAAK.com is authorized to make use of third parties in the execution of your order(s).

Article 10. Applicable law and competent court
10.01. All rights, obligations, offers, orders and agreements to which these Terms and Conditions apply, as well as these Terms and Conditions, shall be governed exclusively by Dutch law.
10.02. All disputes between the parties shall be submitted exclusively to the competent court in the Netherlands, in The Hague.

Article 11. Warranty & Complaints
11.01. Should you not be satisfied with our products or services, please contact BijSMAAK.com. BijSMAAK.com always tries to solve any problems or complaints in consultation with the customer and in the best possible way.
11.02. BijSMAAK.com offers a six (6) month warranty on all items - with the exception of items with a "release date" older than 1 year, for which a warranty period of three (3) months applies - and guarantees that each item delivered meets normal requirements of soundness and usability and existing government regulations. BijSMAAK.com shall determine whether the warranty is applicable and shall determine the method of repair and/or shipment. BijSMAAK.com has an average repair period of three (3) weeks. If BijSMAAK.com decides to replace and offers you an entirely new item, you must make a new choice within six (6) months. If you ship the item to be repaired or replaced, it must have packaging that does not allow for shipping damage. No claim can be made on this BijSMAAK.com Warranty if the defect or wear and tear is apparently the result of negligent maintenance, or if this wear and tear can be considered normal. You may also not claim the BijSMAAK.com Warranty in the following cases:
- If the date and/or order number on the invoice is altered or illegible;
- For defects caused by improper or inappropriate use;
- Damage caused by intent or gross negligence;
- If you fail to give BijSMAAK.com a timely place, opportunity or time to investigate and repair the defect;
- If you default and fail to fulfill your obligations.

Article 12. Application conditions
12.01. The General Terms and Conditions of BijSMAAK.com are also available on request free of charge via Bij SMAAK Handelsonderneming, o.v.v. Voorwaarden Webshop, Bloemerstraat 70, 6511EL Nijmegen. Nothing from this site may be used by third parties without the express permission of BijSMAAK.com. All rights are reserved by BijSMAAK.com.
